2. Who can you contact regarding the processing of your personal data?

As part of implementing personal data protection in our organization, we have decided not to appoint a data protection officer, as this is not mandatory in our situation. For matters related to personal data protection and privacy in the broad sense, you can contact us at the e-mail address support@sneakersjoint.com.

3. What information about you do we hold?

Depending on the purpose, we may process the following information about you:

  • first and last name,
  • home address and delivery address,
  • business address and company name,
  • tax identification number (NIP),
  • e-mail address,
  • phone number,
  • data contained in correspondence addressed to us,
  • details of the orders you place,
  • payment information (payment method and status – we do not receive the full number of your payment card),
  • bank account number,
  • IP address,
  • activity in relation to the newsletters and marketing messages we send,
  • cookie identifiers and information about how you use the store (to the extent described in sections 12–20).

We have described the scope of the data processed precisely for each purpose of processing.

4. Where do we get your personal data from?

In most cases, you provide it to us yourself. This happens when you:

  • create a user account,
  • place an order in the store,
  • submit complaints or withdraw from the contract,
  • subscribe to the newsletter,
  • contact us.

If you made purchases or had an account in the previous version of our online store (before the store was moved to the Shopify platform), we transfer your customer data and order history to the store's current platform. We describe the details in section 6.

In addition, some information about you may be collected automatically by the tools we use or provided to us by other entities:

  • the store platform (Shopify) collects your IP address, among other things when you place an order,
  • the newsletter system (Shopify Email) collects information about your activity in relation to the content sent to you as part of the newsletter (opening messages, clicking links, etc.),
  • the analytics and marketing tools that we activate after you give your consent (with the exceptions described in section 13) collect information about your activity in the store (details in sections 13 and 16),
  • payment operators provide us with information about the status of your payment.

5. Is your data safe?

We care about the security of your personal data. We have analyzed the risks associated with the individual processes in which your data is processed, and then implemented appropriate security and personal data protection measures. We continuously monitor the state of our technical infrastructure, train our staff, review the procedures we use and introduce necessary improvements. If you have any questions about your personal data, we are at your disposal at support@sneakersjoint.com.

6. For what purposes do we process your personal data?

There is more than one purpose. Below is a list of them together with the corresponding legal bases for processing:

  • registration and maintenance of a user account – Article 6(1)(b) of the General Data Protection Regulation (GDPR),
  • order handling – Article 6(1)(b) GDPR,
  • handling payments for orders (Shopify Payments, Klarna) – Article 6(1)(b) GDPR,
  • prevention of fraud and abuse in orders and payments (risk analysis) – Article 6(1)(f) GDPR,
  • handling complaints or withdrawals from the contract – Article 6(1)(f) GDPR,
  • sending the newsletter – Article 6(1)(a) GDPR,
  • handling correspondence – Article 6(1)(f) GDPR,
  • performance of tax and accounting obligations – Article 6(1)(c) GDPR,
  • analytics and statistics (Google Analytics 4, Shopify statistics, Microsoft Clarity) – Article 6(1)(a) GDPR (consent),
  • external marketing (Google Ads, Meta Ads, TikTok Ads, Shopify marketing cookies) – Article 6(1)(a) GDPR (consent),
  • displaying a Google map on the brick-and-mortar store page – Article 6(1)(a) GDPR (consent),
  • measuring the store's performance on the basis of the limited event information that the Google tag sends before you give your consent, as well as analytics and marketing in relation to visitors to the store from countries in which we do not display the cookie banner – Article 6(1)(f) GDPR (details in section 13),
  • protecting the store's forms against spam and bots – Article 6(1)(f) GDPR,
  • transferring customer data and order history from the previous version of the store to the Shopify platform – Article 6(1)(f) GDPR (ensuring continuity in the handling of your account, orders, returns and complaints),
  • creating an archive for the potential need to defend, establish or pursue claims, as well as to identify a returning customer – Article 6(1)(f) GDPR,
  • our own marketing – Article 6(1)(f) GDPR.

User account – details

Creating an account is voluntary – you can also make purchases in our store without an account (as a guest).

When creating a user account, you must provide the data necessary to set up the account: your e-mail address. You log in to your account with a one-time code sent to this address – you do not set a password. Providing the data is voluntary, but necessary to create the account. When editing your account details, you may provide further data (first name, last name, addresses – including a company name – and phone number).

If you had an account in the previous version of our store, we transfer your customer data together with your order history to the current store on the Shopify platform. Passwords from the previous version of the store are not transferred – to log in to your account, enter the e-mail address you have used so far and you will receive a one-time code.

You can modify the information about you at any time. The data will be stored for as long as the account exists. We store order data in our archive until the limitation period for claims related to the order expires and, to the extent required by tax regulations, for the period specified in those regulations (Article 6(1)(f) GDPR).

Orders – details

When you place an order, you must provide the data necessary to fulfill the order. The store platform (Shopify) records the IP address from which you place the order, among other things for the purpose of fraud risk analysis (Article 6(1)(f) GDPR – our legitimate interest in protection against abuse). Each order is saved in our database together with information about the order (ordered products, payment method, delivery method, payment deadline). We also process order data in our internal system for handling orders and inventory levels. The history of orders placed in the previous version of our store is transferred to Shopify and stored on the same terms.

The data collected in connection with an order is processed in order to perform the contract (Article 6(1)(b) GDPR), issue an invoice (Article 6(1)(c) GDPR), include the invoice in the accounting records (Article 6(1)(c) GDPR) and for archival purposes (Article 6(1)(f) GDPR).

Payments – details

Payments in our store are handled by Shopify Payments – a service of Shopify International Limited (Dublin, Ireland). You can pay by payment card, BLIK, Apple Pay, Google Pay, via Klarna or, for deliveries within Poland, on delivery (cash on delivery) – in that case you pay the carrier (InPost or DPD), and any refund is sent by bank transfer to the bank account you indicate. With regard to payment data, we are the controller, and Shopify processes it on our behalf as a processor. Payments are processed and settled by the payment operators that Shopify uses; their current list (including for Poland) is available at https://www.shopify.com/legal/processor-list. Each of the operators may also process your data as an independent controller with regard to its own legal obligations (e.g. anti-money laundering, sanctions) – on the terms described in its privacy notice. If you pay via Apple Pay or Google Pay, you also use the services of Apple or Google on the terms set by those providers. Legal basis for processing data for the purpose of handling payments: Article 6(1)(b) GDPR.

If you choose to pay with Klarna, you will be redirected to Klarna's website. Klarna Bank AB (publ) (Sveavägen 46, 111 34 Stockholm, Sweden) is a separate controller of the data it receives in connection with the payment (including information about the order). Klarna decides on its own which payment options to offer you (e.g. pay now, pay later, payment in 3 installments, financing), and the financing terms depend, among other things, on your creditworthiness. Contact regarding personal data at Klarna: odo@klarna.pl. Klarna privacy notice: https://cdn.klarna.com/1.0/shared/content/legal/terms/0/en_gb/privacy

Complaints and withdrawals from the contract – details

When you submit a complaint or withdraw from the contract, you provide data (first name, last name, address, phone number, e-mail, bank account number). The data is used to carry out the complaint or withdrawal procedure and subsequently for archival purposes (Article 6(1)(f) GDPR – our legitimate interest consists in handling your matter efficiently and in establishing, pursuing or defending any claims).

Newsletter – details

When you subscribe to the newsletter (the form in the store footer), you provide us with your e-mail address. We send the newsletter using the Shopify Email tool (now Shopify Messaging) provided by Shopify. Information about your consent is saved in your customer profile in the store, and the system measures your actions in relation to the messages sent (opens, link clicks). If you subscribed to the newsletter in the previous version of our store, we also transfer the information about your consent.

The data is processed on the basis of consent (Article 6(1)(a) GDPR) and stored until consent is withdrawn. You can unsubscribe from the newsletter at any time – by clicking the link in the footer of each message or by writing to support@sneakersjoint.com.

Correspondence handling – details

When you contact us (e.g. by e-mail or via the contact form in the store), you provide the data contained in your correspondence. Basis: Article 6(1)(f) GDPR – our legitimate interest consists in responding to you and communicating with you.

Tax and accounting obligations – details

Invoices form part of the accounting records, which are retained for the period required by law (Article 6(1)(c) GDPR).

Our own marketing – details

In our store, we use an abandoned cart recovery mechanism. We send e-mail messages encouraging you to complete your order only to persons who have consented to receiving commercial information from us by electronic means. The basis for processing is our legitimate interest (Article 6(1)(f) GDPR), which consists in promoting our products among persons who have started shopping in the store. You give your consent to receiving such messages in accordance with the provisions of the Polish Electronic Communications Law (ustawa – Prawo komunikacji elektronicznej). We display ads tailored to your activity in our store only if you consent to marketing cookies (Article 6(1)(a) GDPR).

7. How long will we store your personal data?

We specify data retention periods below and in the descriptions of the individual purposes of processing (section 6). After these periods expire, we delete or anonymize the data. In particular:

  • user account data – for as long as the account exists,
  • order data, including the IP address recorded with the order for the purpose of risk analysis – until the limitation period for claims related to the order expires (defense against claims, identification of a returning customer) and, to the extent required by tax regulations, for the period specified in those regulations,
  • accounting records, including invoices – for the period required by tax and accounting legislation, as a rule for 5 years from the end of the calendar year in which the tax payment deadline expired,
  • data from complaints and withdrawals from the contract – until the limitation period for contractual claims expires,
  • correspondence – until the matter is resolved, and then until the limitation period for any claims related to it expires,
  • data processed on the basis of consent (e.g. newsletter) – until consent is withdrawn,
  • data used in abandoned cart messages – until you withdraw your consent to receiving commercial information from us or until you object,
  • data analyzed as part of form protection (hCaptcha) – for the period specified in the service provider's privacy policy (section 16),
  • data about your activity collected in Google Analytics 4 – no longer than 14 months from collection, in accordance with the data retention setting in that service,
  • Microsoft Clarity session recordings – for 30 days from recording (selected recordings – up to 9 months),
  • data in the previous version of our store and in its backups – until their transfer to the Shopify platform is completed; we then delete them.

Analytics cookies: up to 2 years (Google Analytics 4 – 2 years by default, Shopify – 1 year). Advertising cookies (Google Ads, Meta, TikTok, Shopify): up to 13 months. The retention periods of individual cookies are given in the Cookie Policy.

8. Who are the recipients of your personal data?

We work with the following data processors:

  • Shopify International Limited (The Sidings, 4th Floor, Grand Canal Quay, Dublin D02 E7K8, Ireland) – the provider of the platform on which our store runs: store hosting, cart and checkout, customer accounts, storage of customer and order data (including data transferred from the previous version of the store), payment handling (Shopify Payments), sending order-related e-mails, newsletter (Shopify Email), cookie consent banner, protection of forms against spam,
  • the payment operators that Shopify uses as part of Shopify Payments (described under “Payments – details”),
  • the provider of the server (hosting) on which our internal system for handling orders and inventory levels runs,
  • the provider of the server (hosting) on which the previous version of our store runs – until the transfer of the data to the Shopify platform is completed and the data is deleted from the previous server,
  • a cloud computing service provider (backups),
  • a CRM system provider,
  • an invoicing system provider,
  • an accounting firm,
  • entities providing technical support services,
  • other subcontractors.

We also use the following marketing and analytics tools and external services:

  • Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) – Google Analytics 4 and Google Ads (Google & YouTube app in Shopify) as well as Google Maps. Parent company: Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
  • Meta Platforms Ireland Limited (Merrion Road, Dublin 4, D04 X2K5, Ireland) – Meta Pixel, Meta Conversions API, Meta Ads (Facebook & Instagram app in Shopify). Parent company: Meta Platforms, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA.
  • TikTok Technology Limited (10 Earlsfort Terrace, Dublin, D02 T380, Ireland), jointly with TikTok Information Technologies UK Limited – TikTok Pixel, TikTok Ads (TikTok app in Shopify).
  • Microsoft Ireland Operations Limited (One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland) – Microsoft Clarity (statistics, heatmaps and session recordings). Parent company: Microsoft Corporation, One Microsoft Way, Redmond, WA 98052, USA.
  • Intuition Machines, Inc. (1065 SW 8th St #704, Miami, FL 33130, USA) – hCaptcha, protection of forms against spam, used by the Shopify platform.

To a certain extent, Shopify processes data as a separate controller: as part of the Shopify Network Intelligence services (which we use, among other things, in connection with the Shopify Email newsletter) and with regard to data that Shopify receives as part of your direct relationship with Shopify (e.g. the Shop app and Shop Pay). Shopify also processes data about your visit and purchases for the purposes of services based on your interactions with other merchants using Shopify and with Shopify itself; for this purpose, this information may be shared with Shopify and other entities, which may be located in other countries. In the cookie banner, we ask for your consent to ads based on your activity in our store, with other merchants and on Shopify – you can withdraw your consent at any time. Details: Shopify Consumer Privacy Policy – https://www.shopify.com/legal/privacy/consumers, Shopify privacy portal (where you can also withdraw your consent or object to processing by Shopify) – https://privacy.shopify.com. Contact details of Shopify's data protection officer for persons in the EEA: Shopify International Ltd., Attn: Data Protection Officer, c/o Intertrust Ireland, 2nd Floor 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland.

Your data is shared with courier companies and parcel locker operators (e.g. InPost, DPD) to the extent necessary to deliver your order and, for payment on delivery (cash on delivery), also the amount to be collected. These companies become independent controllers of your personal data. If you choose to pay with Klarna, your data is transferred to Klarna Bank AB (publ), which also becomes an independent controller (details under “Payments – details”). Your personal data may also be transferred to tax offices to the extent necessary to fulfill tax, settlement and accounting obligations. Where such a need arises, your personal data may be disclosed to entities authorized to obtain access to it under the law (courts, public prosecutors, law enforcement and security services).

9. Do we transfer your data to third countries or international organizations?

Yes, some operations involved in processing your personal data may entail transferring it to third countries, in particular to the USA and Canada. This applies to the Shopify platform (together with its subcontractors) and to the Google, Meta, TikTok, Microsoft Clarity and hCaptcha tools.

Data is transferred outside the European Economic Area on the basis of:

  • Standard Contractual Clauses (SCC) approved by the European Commission,
  • the Data Privacy Framework (EU-US Data Privacy Framework, in effect since 10 July 2023) with respect to certified entities (Google LLC, Meta Platforms, Inc., Microsoft Corporation, as well as Intuition Machines, Inc., which declares its participation in this program),
  • in the case of Shopify: Shopify's Binding Corporate Rules (BCR) approved by European data protection authorities (transfers between Shopify companies), the European Commission decision finding an adequate level of data protection in Canada, and the 2021 Standard Contractual Clauses (Decision 2021/914) – for transfers to other countries without an adequate level of protection.

The EU-US Data Privacy Framework replaced the Privacy Shield mechanism, which was invalidated by the judgment of the Court of Justice of the European Union of 16 July 2020 (Schrems II). You can check the current certification status at: https://www.dataprivacyframework.gov/list

You can obtain a copy of the safeguards applied when transferring data outside the European Economic Area (e.g. the standard contractual clauses) by writing to support@sneakersjoint.com.

The Shopify platform (including the Shopify Email newsletter) — the data of customers from the EEA is primarily processed by Shopify International Limited (Ireland); however, Shopify may process data in any country in which Shopify, its affiliates or its providers operate, including Canada and Singapore. Shopify's key subcontractors include Amazon Web Services, Inc. (USA) and Google Cloud Canada Corporation (Canada) – hosting and cloud data processing, Cloudflare, Inc. (USA) – load balancing and protection against DDoS attacks, Adyen N.V. (the Netherlands) and other payment service providers – payment handling, Mailgun Technologies, Inc. and Twilio Inc. (USA) – sending e-mails and SMS messages. List of Shopify subcontractors: https://help.shopify.com/en/manual/privacy-and-security/privacy/subprocessors

10. Do we use profiling? Do we make automated decisions based on your personal data?

We do not make decisions about you based solely on automated processing, including profiling, that would produce legal effects concerning you or similarly significantly affect you.

After you give your consent, we use tools that serve you personalized ads based on your previous activity in our store (behavioral advertising). Detailed information about behavioral advertising and the option to manage your settings: https://www.youronlinechoices.com.

We do not identify you directly on the basis of the information collected through marketing tools. This information may include:

  • information about the operating system and browser,
  • pages viewed,
  • time spent on the site,
  • navigation between pages,
  • traffic source,
  • age range, gender, approximate location,
  • interests determined on the basis of online activity.

11. What rights do you have in connection with the processing of your personal data?

The GDPR grants you the following rights:

  • the right to access your data and to receive a copy of it,
  • the right to rectification (correction) of your data,
  • the right to erasure of data (the “right to be forgotten”),
  • the right to restriction of processing,
  • the right to object to processing (including, at any time, to processing for direct marketing purposes),
  • the right to data portability,
  • the right to withdraw consent at any time – without affecting the lawfulness of processing carried out before its withdrawal,
  • the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes UODO, https://uodo.gov.pl/en).

Right to object. You may at any time object to the processing of your data carried out on the basis of our legitimate interest (Article 6(1)(f) GDPR) – on grounds relating to your particular situation. You may object to processing for direct marketing purposes at any time, without giving a reason – we will then stop processing your data for that purpose.

To exercise your rights, write to: support@sneakersjoint.com

12. Do we use cookies, and what exactly are they?

Like almost all other websites, our store uses cookies. Cookies are small pieces of text information stored on your end device. Some cookies are deleted when the session ends (session cookies), while others are retained (persistent cookies). You will find a detailed list of the cookies used in the store in the Cookie Policy.

13. On what basis do we use cookies?

We use cookies on the basis of your consent, except where cookies are necessary for the proper provision of a service to you by electronic means, and subject to the exceptions described in this section. We collect consents using the cookie banner built into the Shopify platform, which we display to visitors from Poland and most other countries of the European Economic Area, as well as from the United Kingdom. In these countries, cookies that are not necessary remain blocked until you give your consent. Your decision applies to the pixels of the tools operating in the store (Google, Meta, TikTok), and it is passed on to Google via the Google & YouTube app as part of the Google Consent Mode v2 mechanism. We activate Microsoft Clarity and the Google map only after you give the relevant consent (the map – also after you click the “Show Google map” button).

The Google tag from the Google & YouTube app loads on every visit. Without your consent, it does not store cookies, but it may send Google limited information about events (e.g. a page or product view, a purchase) without cookie identifiers. If you do not give your consent, Google does not use such information originating from persons in the European Economic Area for personalized advertising. We process this limited information on the basis of our legitimate interest, i.e. to measure the store's performance and the effectiveness of our offers in Google services (Article 6(1)(f) GDPR). You can object (section 11).

If you visit the store from a country in which the banner is not displayed, the Shopify default settings for your region apply. They may allow analytics and marketing cookies (as well as the activation of Microsoft Clarity) without a separate request for consent. We process data collected in this way on the basis of our legitimate interest, i.e. to analyze the store's performance and to promote our offer (Article 6(1)(f) GDPR). You can object (section 11) or block these cookies in your browser (section 14). The rules described in this policy, under which analytics and marketing tools are activated only after you give your consent, apply to the countries in which we display the banner.

14. Can you disable cookies?

Yes, you can manage cookie settings in your web browser. You can block all or selected cookies, use incognito mode or delete previously stored cookies. We also give you the ability to control them from within our store — we use a consent management mechanism (the cookie banner built into the Shopify platform) that allows you to block cookies you do not want. You can change your decision or withdraw your consent at any time using the “Cookie preferences” link in the store footer – withdrawing consent is as easy as giving it.

15. For what purposes do we use first-party cookies?

First-party cookies (set in our store by the Shopify platform) are used to ensure the proper functioning of the store, including maintaining your session after you log in, handling checkout, and remembering the products added to your cart, the selected country and your decision regarding cookies. Information about your cart and an order you have started is also used to support the abandoned cart recovery mechanism (section 6, “Our own marketing – details”).

In addition, in your browser's local storage (localStorage) we save a list of recently viewed products, the selected size system, the automatically selected country and information about the language change suggestion – solely in order to display them in the store and remember your settings. You can delete this information at any time by clearing the site data in your browser.

16. Which third-party cookies are used?

The following third-party tools operate within our store (some of them store cookies in our store's domain and some in their providers' domains):

  • Google Analytics 4 (Google & YouTube app)
  • Google Ads (formerly AdWords; Google & YouTube app)
  • Meta Pixel + Meta Conversions API (Facebook & Instagram app)
  • TikTok Pixel (TikTok app)
  • Shopify – the store platform provider (Shopify statistics and Shopify marketing cookies, cookie banner; we described the necessary cookies in section 15)
  • Microsoft Clarity
  • Google Maps (map on the brick-and-mortar store page)
  • hCaptcha (protection of forms against spam, activated by the Shopify platform)

Google Analytics 4 – details

We use the Google Analytics 4 (GA4) tool provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). Parent company: Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

We carry out these activities on the basis of your consent (Article 6(1)(a) GDPR), given in the cookie banner. GA4 is activated in the store by the Google & YouTube app in Shopify, and information about your decision (consent or its absence) is passed on to Google as part of Google Consent Mode v2. Without your consent, GA4 does not store analytics cookies on your device, but the Google tag may then send Google limited information about events (e.g. a page or product view, a purchase) without cookie identifiers – we described this in section 13. With regard to Google Analytics, Google acts as a processor on our behalf.

According to Google, Google Analytics 4 does not log or store IP addresses. GA4 collects, among other things:

  • pages viewed,
  • time spent in the store,
  • e-commerce events (product view, add to cart, purchase),
  • traffic source (channel, campaign),
  • technical browser and device data,
  • approximate location (country/city).

Browser add-on that blocks Google Analytics: https://tools.google.com/dlpage/gaoptout

Google Ads – details

We use the conversion tracking and remarketing features of the Google Ads system operated by Google Ireland Limited (Dublin, Ireland), activated in the store by the Google & YouTube app in Shopify. Parent company: Google LLC. With regard to Google Ads, Google acts as an independent data controller.

We carry out these activities on the basis of your consent (Article 6(1)(a) GDPR).

After you consent to marketing cookies, a Google cookie that collects information about your activity is stored on your device. This allows us to show you ads on the Google network depending on your behavior in our store. We may also use the Enhanced Conversions feature — Google then receives hashed data (e-mail, phone number) from a completed order in order to better match conversions. Hashing means that the data is not transmitted in a readable form.

Google ad settings: https://adssettings.google.com/

Meta Pixel + Meta Conversions API – details

We use tools of the Meta Ads advertising system provided by Meta Platforms Ireland Limited (Merrion Road, Dublin 4, D04 X2K5, Ireland), activated in the store by the Facebook & Instagram app in Shopify. Parent company: Meta Platforms, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA.

We carry out these activities on the basis of your consent (Article 6(1)(a) GDPR).

We use two measurement methods, which operate in parallel:

  1. Meta Pixel (in the browser): JavaScript code in your browser sends information about your activity (product view, add to cart, start of checkout, purchase) directly to Meta.
  2. Meta Conversions API (server-side): Shopify, on our behalf and via the Facebook & Instagram app, sends hashed order data directly to Meta. Hashing means that your e-mail, phone number, first name and last name are not transmitted in a readable form — Meta uses the hashed values solely to match conversions.

Events sent by both methods are deduplicated so that Meta does not count conversions twice.

We do not use this information to identify you; however, it constitutes personal data (including online identifiers). Meta may combine the information collected with other data within your Facebook/Instagram account and use it for its own marketing purposes. Such activities of Meta are beyond our control.

With regard to the collection of data about events in our store and its transfer to Meta, we are joint controllers together with Meta Platforms Ireland Limited (Article 26 GDPR). Meta carries out further processing of the data after its transfer as an independent controller. You can exercise your rights under Articles 15–21 GDPR with regard to data processed by Meta directly against Meta.

Meta ad settings: https://www.facebook.com/ads/preferences

TikTok Pixel – details

We use the TikTok Pixel tool provided by TikTok Technology Limited (10 Earlsfort Terrace, Dublin, D02 T380, Ireland), activated in the store by the TikTok app in Shopify.

We carry out these activities on the basis of your consent (Article 6(1)(a) GDPR).

The Pixel collects data about activity in the store (product view, add to cart, start of checkout, purchase) in order to measure the effectiveness of TikTok advertising campaigns and for remarketing. We do not use this information to identify individual users. With regard to the collection of data via TikTok Pixel and its transfer to TikTok, we are joint controllers of personal data together with TikTok Technology Limited (Article 26 GDPR). We are responsible for obtaining your consent and for informing you about this processing. Further processing of the data after its transfer to TikTok is carried out by TikTok (TikTok Technology Limited jointly with TikTok Information Technologies UK Limited) as a controller, in accordance with its privacy policy. We will make the essence of the arrangement with TikTok available to you upon request sent to support@sneakersjoint.com.

Shopify – details

Our store runs on the Shopify platform provided by Shopify International Limited (The Sidings, 4th Floor, Grand Canal Quay, Dublin D02 E7K8, Ireland). Shopify sets cookies in our store that are necessary for its operation (including cart, session and checkout, security, country selection) and, after you give your consent, also analytics cookies (_shopify_analytics) and marketing cookies (_shopify_marketing) containing data from the store and checkout pages (lifetime: 1 year).

Through Shopify, we also send order-related messages (order confirmations, status updates) and the newsletter (Shopify Email). Legal basis: Article 6(1)(b) GDPR (performance of the contract) for order-related messages, Article 6(1)(a) GDPR (consent) for the newsletter, and Article 6(1)(f) GDPR (legitimate interest) for abandoned cart messages, which we send only to persons who have consented to receiving commercial information from us by electronic means.

Shopify cookie banner – consent management

To collect and remember your cookie consents, we use the cookie banner built into the Shopify platform. The banner may be displayed in the store, in the cart, at checkout and on customer account pages. In it, you can accept all cookie categories, reject cookies other than necessary ones or choose individual categories. In the countries in which we display the banner, until you give your consent we do not store cookies other than necessary ones, and analytics and marketing tools do not collect data (except for the limited information sent by the Google tag, described in section 13) – unless you request it yourself, e.g. by clicking the “Show Google map” button. Your decision is automatically passed on to the Shopify consent mechanism (Customer Privacy API) and applies to the pixels of the tools operating in the store and at checkout. You can change your decision or withdraw your consent at any time – via the “Cookie preferences” link in the store footer.

Microsoft Clarity – details

We use the Microsoft Clarity tool provided by Microsoft Ireland Operations Limited (One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland). Parent company: Microsoft Corporation, One Microsoft Way, Redmond, WA 98052, USA.

Clarity helps us understand how you use the store: it creates aggregate statistics and heatmaps (e.g. where you click and how far you scroll down pages) as well as session recordings, i.e. a replay of your actions on the store's pages (cursor movements, clicks, scrolling). On this basis, we improve the functioning and appearance of the store.

We activate the Clarity script only after you consent to analytics cookies in the banner (Article 6(1)(a) GDPR), and information about your decision is also passed on to Clarity. Clarity stores cookies on your device that make it possible to recognize subsequent page views and visits. Microsoft also processes the data collected by Clarity as a controller, on the terms described in the Microsoft Privacy Statement. Session recordings are stored for 30 days from recording (selected recordings – up to 9 months). Data may be transferred to the USA (section 9).

Google Maps – details

On the page with information about our brick-and-mortar store, we display a Google map provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). Parent company: Google LLC.

The map loads only after you consent to preference cookies in the banner or after you click the “Show Google map” button (Article 6(1)(a) GDPR). Until then, instead of the map you see the button and a regular link to Google Maps. Once the map has loaded, Google receives your IP address and information about your browser and may store cookies.

hCaptcha – protection of forms against spam

To protect the forms in our store (including the contact form and the newsletter sign-up form) against abuse and spam, the Shopify platform uses the hCaptcha service provided by Intuition Machines, Inc. (1065 SW 8th St #704, Miami, FL 33130, USA). hCaptcha analyzes how the form is used (including cursor movements, scrolling, keystrokes, IP address and browser data) in order to distinguish a human from a bot, and may store cookies. If abuse is suspected, you may be asked to solve a simple task.

Legal basis: Article 6(1)(f) GDPR (legitimate interest – protection against bots and abuse). Data may be transferred to the USA; Intuition Machines, Inc. declares compliance with the EU-US Data Privacy Framework principles.

17. Do we track your behavior within our store?

Yes, we use Shopify statistics and marketing cookies as well as the Google Analytics 4, Google Ads, Meta Pixel + Meta Conversions API, TikTok Pixel and Microsoft Clarity tools, which collect information about your activity on the site. We store the cookies of these tools, and the tools themselves collect data, only after you give your consent in the cookie banner (exception: the limited information that the Google tag sends without cookies – section 13). If you visit the store from a country in which the banner is not displayed, the Shopify default settings for your region apply (section 13). We describe the details in section 16.

18. Do we serve you targeted ads?

Yes, we use Google Ads, Meta Ads and TikTok Ads, through which – after you give your consent – we may target ads to specific audiences defined on the basis of various criteria, such as age, gender, interests and actions previously taken on our site (remarketing).

19. How can you manage your privacy?

Below you will find a list of ways to manage your privacy:

20. What are server logs?

Using the store involves sending requests to the server. The servers on which our store runs are provided by Shopify – each request is recorded in the server logs kept by Shopify as the platform provider. The logs include, among other things, your IP address, the server date and time, and information about your web browser and operating system. The data recorded in the server logs is not associated with specific individuals and is not used by us to identify you.

21. Is there anything else you should know?

As you can see, the subject of personal data processing, the use of cookies and the management of privacy in general is quite complicated. We have made every effort to ensure that this document gives you as thorough an understanding as possible of the matters that are important to you. If anything is unclear to you, you want to learn more or you simply want to talk about your privacy, write to us at support@sneakersjoint.com.

22. Can this privacy policy change?

Yes, we may modify this privacy policy, in particular due to technological changes on the part of our store and changes in the law. If you are a registered user of the store, we will inform you about material changes to the privacy policy by e-mail or by a notice in the store. We will make archived versions of the privacy policy available to you upon request sent to support@sneakersjoint.com.
